Permit requirements for bathroom remodels on Long Island are stricter than many homeowners expect — and more variable than people realize. Whether your project needs a permit depends on the scope of work, your specific town or village, and whether licensed tradespeople are involved. Getting this wrong can cause serious problems when you sell your home.

When a Permit Is Required on Long Island

In Nassau and Suffolk County, a building permit is generally required when your bathroom remodel involves any of the following:

Plumbing work: Moving or adding plumbing lines, relocating a sink, toilet, or shower drain, or installing new supply lines typically requires a plumbing permit pulled by a licensed plumber. In-kind replacement of fixtures (swapping an old toilet for a new one in the same location) usually doesn't require a permit, but any pipe work does.

Electrical work: Adding recessed lighting, installing a new exhaust fan with its own circuit, adding a GFCI outlet, or upgrading a panel circuit for heated floors requires an electrical permit from your town's building department. Like-for-like fixture swaps (replacing an old vanity light with a new one using existing wiring) typically don't require a permit.

Structural changes: Moving walls, altering window openings, or removing load-bearing walls always require a permit regardless of which town you're in.

Adding a bathroom where there wasn't one: Always requires a permit — plumbing, electrical, and building.

Nassau County vs. Suffolk County Permit Rules

Permit requirements and fees vary significantly across Long Island's many towns, villages, and incorporated areas. There is no single "Long Island" standard.

Nassau County: Towns like Hempstead, North Hempstead, and Oyster Bay each have their own building departments. Many incorporated villages within these towns have additional layers. A bathroom remodel in Great Neck Plaza (a village within the Town of North Hempstead) requires going through the village building department, not the town. Permit fees in Nassau County typically run $300–$800 for a standard bathroom remodel.

Suffolk County: Towns like Babylon, Islip, Brookhaven, Smithtown, and Huntington have different requirements and processing times. Huntington Town is known for thorough inspections. Brookhaven covers a large geographic area with varying enforcement levels by district. Permit fees in Suffolk County are generally $200–$600 for bathroom work.

What "pulling a permit" actually involves: Your licensed contractor (or licensed plumber/electrician) submits plans or a description of work to the building department. The department reviews and issues a permit. Work proceeds, and inspections are scheduled at key stages. At completion, a final inspection is performed and the permit is closed. This process protects you — it confirms the work was done to code.
